Recognition can be formalized through a public deed or a declaratory lawsuit. Dissolution, on the other hand, can occur extrajudicially if both parties agree or judicially when there are disputes over asset division, child custody, or alimony.
In cases of litigious dissolution, the couple’s chosen property regime applies. If no agreement exists, the partial community property regime is applied by default.
Conclusion
Formalizing a stable union helps prevent complications during its dissolution. A cohabitation agreement can facilitate both the recognition of the union and its eventual dissolution.
